A Louisiana film production company, Stellarblade, is suing Sony and Shift Up, the developer of the PS5 game Stellar Blade, for trademark infringement. The plaintiff, Griffith Chambers Mehaffey, claims that the similarity between the names and logos, including the stylized "S," causes confusion among potential customers. He registered the "Stellarblade" trademark in June 2023, after Shift Up registered "Stellar Blade" in January 2023, but argues that his company has used the name and website stellarblade.com since 2011.
Mehaffey's lawsuit seeks monetary damages, attorney fees, and an injunction to prevent further use of the "Stellar Blade" trademark. He also requests the destruction of all related materials. His lawyer argues that Sony and Shift Up should have been aware of Mehaffey's established rights before adopting a nearly identical name, especially considering Stellar Blade's earlier working title, "Project Eve."
The case highlights the complexities of trademark law, including the retroactive application of trademark rights. Mehaffey contends that Sony and Shift Up's actions have driven his business into "digital obscurity," impacting his livelihood.
The outcome of this lawsuit will be closely watched by the gaming and film industries, underscoring the importance of thorough trademark research before launching new products.
